Grievance Redressal Timeline

In compliance with Consumer Protection (E-Commerce) Rules 2020, we follow a structured timeline for addressing customer grievances:

  • Within 48 hours: All grievances must be acknowledged. You will receive email/SMS confirmation of receipt with a reference number.
  • Within 7 days: Initial investigation and response to grievance. We will contact you with findings and proposed resolution.
  • Within 30 days: Full resolution or escalation notice. All disputes must be resolved or formally escalated to next stage by this date.
  • After 30 days: If unresolved, customer may escalate to Consumer Disputes Redressal Commission or initiate legal action.

Dispute Resolution Process

Our formal dispute resolution follows these stages:

Stage 1: Informal Resolution (Days 1-7)

Contact our Grievance Officer directly via email or phone. We attempt to resolve through discussion and negotiation.

Stage 2: Formal Complaint (Days 7-30)

Submit written complaint with evidence (booking confirmation, chat logs, photos). We investigate and provide written response within 30 days.

Stage 3: Escalation (Day 30+)

If unresolved, customer may escalate to District Consumer Commission or pursue legal action under applicable laws.

Governing Law & Jurisdiction

Applicable Law: These terms and all rental agreements are governed by and shall be construed in accordance with the laws of the Republic of India, specifically the Consumer Protection Act 2019, the Information Technology Act 2000, and the laws of the State of Rajasthan.

Exclusive Jurisdiction: All legal disputes arising from or relating to your rental with BROTHERSCRICSSHOP shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan. You agree to submit to such jurisdiction and agree not to assert any claim or right on any other forum or jurisdiction.

Statutory Rights: Nothing in these terms shall exclude or limit your statutory rights as a consumer under the Consumer Protection Act 2019 or any other applicable law.

Liability Amount Cap

In accordance with the Consumer Protection Act 2019 and standard commercial practice, BROTHERSCRICSSHOP's liability for any claim or dispute arising from rental services is limited to a maximum of ₹5,000 per rental.

What Does This Cap Cover?

  • Equipment defects or malfunctions
  • Damaged or defective equipment at pickup
  • Lost or misplaced equipment
  • Refund disputes or billing errors
  • Website technical issues affecting bookings

This cap does NOT apply to: Personal injuries from equipment use (see Safety Disclaimer), third-party property damage, or claims arising from customer breach of rental terms.

How to Claim: All liability claims must be filed within 30 days of the incident. Claims exceeding ₹5,000 will be processed for the ₹5,000 cap amount only. The ₹5,000 cap is the full and complete remedy for all damages, indirect or direct.

Data Breach Notification Policy

In compliance with the Information Technology Act 2000 Section 72A and the Consumer Protection Act 2019, BROTHERSCRICSSHOP maintains strict data security protocols and will notify affected customers in the event of a confirmed data breach.

Notification Requirement:

🔔 WITHIN 48 HOURS of discovering a confirmed data breach affecting your personal information, BROTHERSCRICSSHOP will notify you via email, SMS, and phone call with:

  • Nature of breach: What type of data was affected (name, email, phone, booking details, payment information, etc.)
  • Scope of exposure: How many customers were affected
  • When discovered: Date and time breach was identified
  • What we're doing: Immediate remedial actions taken (data frozen, systems patched, law enforcement notified)
  • Your next steps: Recommended actions (change passwords, monitor accounts, place fraud alerts, check credit reports)
  • Support contact: Dedicated grievance team for breach-related issues

Law Enforcement & Regulatory Notification:

Within 72 hours of discovering a breach affecting protected data, BROTHERSCRICSSHOP will notify the Cybercrime Coordination Centre (I4C) and the Nodal Officer for the jurisdiction as required by law.

Your Rights:

  • Right to know the nature and extent of data breach
  • Right to file complaint with Data Protection authority
  • Right to compensation for damages (up to ₹5,000 liability cap under insurance/terms)
  • Right to request deletion of your data post-breach

Dispute Arbitration & Settlement

BROTHERSCRICSSHOP is committed to resolving disputes quickly and fairly. Before pursuing legal action in courts, both parties agree to attempt resolution through the following arbitration and settlement process.

Mandatory Pre-Litigation Arbitration:

Any dispute with BROTHERSCRICSSHOP must be subject to good faith negotiation and mediation (arbitration) before either party initiates court proceedings. This includes rental disputes, billing disputes, equipment damage disputes, refund disputes, or service failures.

Stage 1: Direct Negotiation (Days 1-7)

Contact Grievance Officer directly. Exchange positions, evidence, and proposed settlements via email/call. No lawyers required at this stage.

Stage 2: Formal Mediation (Days 7-21)

If unresolved, both parties engage a neutral third-party mediator (mutually agreed or appointed). Mediator facilitates discussion and proposes compromises. Both parties accept mediator's non-binding recommendation in writing.

Stage 3: Binding Arbitration (Days 21-45)

If mediation fails, dispute goes to binding arbitration before a single arbitrator (mutually agreed). Arbitrator's decision is final and enforceable in court. Arbitration follows the Arbitration and Conciliation Act 1996.

Stage 4: Legal Action (Day 45+)

Only after exhausting negotiation/mediation/arbitration may either party pursue court action in Jaipur courts. Consumer protection laws and statutory rights apply.

Arbitration Venue & Costs:

  • Venue: Jaipur, Rajasthan (or mutually agreed location)
  • Arbitrator Fees: Split equally between both parties
  • Mediator Fees: Split equally between both parties (typically ₹2,000-₹5,000 total)
  • Duration: All stages must be completed within 45 days (extendable by mutual consent)

Exceptions (Direct Court Action Allowed):

Arbitration requirement is waived for:

  • Claims involving serious criminal conduct or fraud
  • IP violations or trade secret theft
  • Emergency injunctive relief needed (temporary restraining orders)
  • Claims under ₹10,000 (small claims can go straight to consumer commission)

By using BROTHERSCRICSSHOP services, you agree to this mandatory arbitration process and waive your right to jury trial (if applicable) and class action lawsuits.

Important Legal Notices

Liability Limitation: BROTHERSCRICSSHOP's total liability for any claim arising from your rental shall not exceed the security deposit amount paid for that rental. We are not liable for indirect, incidental, special, or consequential damages.

Force Majeure: We are not liable for delays or failures in performance resulting from acts beyond our control (natural disasters, government actions, pandemics, etc.). In such cases, rental fees may be refunded or rescheduled at our discretion.
