Our formal dispute resolution follows these stages:

Applicable Law: These terms and all rental agreements are governed by and shall be construed in accordance with the laws of the Republic of India, specifically the Consumer Protection Act 2019, the Information Technology Act 2000, and the laws of the State of Rajasthan.
Exclusive Jurisdiction: All legal disputes arising from or relating to your rental with BROTHERSCRICSSHOP shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan. You agree to submit to such jurisdiction and agree not to assert any claim or right on any other forum or jurisdiction.
Statutory Rights: Nothing in these terms shall exclude or limit your statutory rights as a consumer under the Consumer Protection Act 2019 or any other applicable law.
In accordance with the Consumer Protection Act 2019 and standard commercial practice, BROTHERSCRICSSHOP's liability for any claim or dispute arising from rental services is limited to a maximum of ₹5,000 per rental.
This cap does NOT apply to: Personal injuries from equipment use (see Safety Disclaimer), third-party property damage, or claims arising from customer breach of rental terms.
How to Claim: All liability claims must be filed within 30 days of the incident. Claims exceeding ₹5,000 will be processed for the ₹5,000 cap amount only. The ₹5,000 cap is the full and complete remedy for all damages, indirect or direct.

BROTHERSCRICSSHOP is committed to resolving disputes quickly and fairly. Before pursuing legal action in courts, both parties agree to attempt resolution through the following arbitration and settlement process.
Any dispute with BROTHERSCRICSSHOP must be subject to good faith negotiation and mediation (arbitration) before either party initiates court proceedings. This includes rental disputes, billing disputes, equipment damage disputes, refund disputes, or service failures.
Contact Grievance Officer directly. Exchange positions, evidence, and proposed settlements via email/call. No lawyers required at this stage.
If unresolved, both parties engage a neutral third-party mediator (mutually agreed or appointed). Mediator facilitates discussion and proposes compromises. Both parties accept mediator's non-binding recommendation in writing.
If mediation fails, dispute goes to binding arbitration before a single arbitrator (mutually agreed). Arbitrator's decision is final and enforceable in court. Arbitration follows the Arbitration and Conciliation Act 1996.
Only after exhausting negotiation/mediation/arbitration may either party pursue court action in Jaipur courts. Consumer protection laws and statutory rights apply.

By using BROTHERSCRICSSHOP services, you agree to this mandatory arbitration process and waive your right to jury trial (if applicable) and class action lawsuits.
Liability Limitation: BROTHERSCRICSSHOP's total liability for any claim arising from your rental shall not exceed the security deposit amount paid for that rental. We are not liable for indirect, incidental, special, or consequential damages.
Force Majeure: We are not liable for delays or failures in performance resulting from acts beyond our control (natural disasters, government actions, pandemics, etc.). In such cases, rental fees may be refunded or rescheduled at our discretion.
